Privacy Policy

Introduction

Reliance Petroleum is the face of BP in regional and rural Queensland and northern New South Wales. Reliance operates in a territory from Torres Strait Islands in the north to Coffs Harbour in the south, and west from the eastern seaboard to rural and outback Queensland and northern New South Wales. Reliance Petroleum supplies around one billion litres of petroleum product into the market place each year together with providing a wide range of products, services and expertise.

Our core belief is "sustaining growth through commitment to customers, colleagues and community". Our focus is on excellence on each level of our operations. As a necessary part of our business, and to meet our core belief and goals we will collect personal information.

The Privacy Act 1988 (As Amended) governs how we treat the personal information which we collect.

"Personal information" is defined under the Privacy Act as "information or an opinion, whether true or not, regarding a person where the identity of the person is apparent or can reasonably be ascertained from the information or opinion."

Put simply, it is information by which a person may be identified.

The Privacy Act has set out National Privacy Principles to deal with personal information.

At Reliance, we are committed to complying with the Privacy Act and the National Privacy Principles and any other Privacy Code to which Reliance is bound to comply, as part of our core belief and goals.

This Privacy Policy demonstrates this commitment. This Policy is designed to broadly identify the controls which Reliance has in place to comply with the Privacy Act and National Privacy Principles. In doing so, we aim to:

  1. ensure appropriate and adequate collection, storage and security of personal information
  2. set out the circumstances in which personal information may be disclosed by Reliance to somebody else
  3. set out how you can access your personal information from Reliance and
  4. set out what you can do if you are not happy with the way Reliance has treated your personal information.

Who is Reliance Petroleum?

We have set out in our introduction the type and nature of our business, our core beliefs and goals.

In this Policy, "Reliance" means Centrel Pty Ltd (ACN 091 614 667) trading as Reliance Petroleum and each of its subsidiaries.

 

Why We Collect Information

Reliance collects personal information for the purpose of, and conduct of our business. Reliance collects personal information:

  • to maintain and administer relationships with our customers, colleagues and the community
  • to provide customers, colleagues and the community goods and services which they request
  • to determine a credit applicant’s ability to repay the debt,
  • for security reasons e.g. by way of Reliance’s security video surveillance
  • for monitoring and evaluating our goods and services
  • to enable us in assisting you with queries
  • to conduct trade promotions, competitions and the like,
  • to assist in any other lawful purpose directly related to the business of Reliance Petroleum.

Who Does This Privacy Policy Apply To?

This Policy applies to anybody in respect of whom Reliance currently holds, or may in the future, collect personal information.

What Information Does This Privacy Policy Apply To?

As stated, this Policy applies to personal information, the definition of which is set out in the Introduction.

This Policy may also apply to "Sensitive Information". "Sensitive Information" is information or an opinion about a person’s racial or ethnic origin, political opinions, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences or practices, criminal records or health.

Generally, we do not collect information about your political, religious beliefs or opinions or your racial or ethnic origins or your sexual preferences or practices. However, other information which may be classed as sensitive information may be required in some circumstances.

What Information is not Personal Information?

Where a person is no longer able to be identified from the information, it is not considered to be personal information. For example, the fact that a number of persons of a certain age group have entered a Reliance competition, is not personal information.

Reliance may use this information for its own purposes and commercial gain.

How and When Does Reliance Collect Personal Information?

The manner in which Reliance collects personal information will depend upon your relationship with Reliance. Reliance will always collect information by lawful and fair means for a purpose directly related with a function or activity of Reliance.

An example of how Reliance may collect personal information is by your completion of a Credit Terms Application Agreement. Other ways in which we may collect personal information include:

  • providing goods and services to customers, colleagues and the community
  • responding to questions regarding our products and our business
  • interacting with people concerning our business including via our website
  • conducting trade promotions and competitions and security video surveillance at Reliance sites

Where personal information is collected, we will take such reasonable and practicable steps as are necessary to inform the person that the personal information is being collected, the purpose for which the personal information is being collected, if necessary the fact that the collection of the information is authorised or required by law and details of any body or organization to whom any such personal information may be disclosed.

We will attempt to do this at the time the information is being collected however, if we are unable to do that, we will advise the person as soon as practicable after the information is collected.

In some circumstances, it is necessary for Reliance to collect personal information through third party service providers or agents (for example, operators of Reliance service stations).

Collection of Sensitive Information

As outlined above, Reliance does not generally obtain some types of sensitive information. However, Reliance will not collect any sensitive information without the consent of the person to whom it relates unless the collection is required by law, is necessary to prevent or lessen a serious or imminent threat to the person (or another person’s life or health), or is necessary in relation to legal proceedings (current, anticipated or potential).

What Information Do We Collect?

Generally, the personal information collected by Reliance comprises name, address, driver’s license number, date of birth, gender, occupation, contact details, bank account or credit card details (when using direct debit), business details including nature of business, Registered Office, ACN and ABN, and trade references. This is not an exhaustive definition of all information which we might require but sets out generally the type of personal information which we obtain.

How Does Reliance Use Personal Information?

The use to which we can put personal information depends on the reason for which it was collected and that person’s relationship with Reliance.

Reliance will only use information for a lawful purpose directly related with our business.

Reliance may use personal information for its primary purpose of collection (e.g. the delivery of goods or services to a person) or for a related secondary purpose that we could reasonably be expected to use the personal information for in the course of our business.

In certain circumstances, Reliance may use personal information for promotional or direct marketing purposes. However, a person may at any time request Reliance not to use their personal information for sending direct marketing material to that person. Such a request can be made by contacting Reliance either in writing, by email or by telephone at the contact details provided. Reliance will not charge a fee for making such a request.

Disclosure of Personal Information

In maintaining our core beliefs, Reliance respects the privacy of any person from whom we might collect personal information. Reliance will take all reasonable steps to keep that information strictly confidential and will not disclose personal information without your consent except for the circumstances set out below. Reliance will disclose personal information to third parties if you have been made aware that disclosure is likely or if it is reasonably necessary for the primary purpose of collecting the information.

Otherwise, Reliance may disclose personal information to third parties without the consent of the person to whom it relates if the disclosure is:

  1. necessary to protect or enforce Reliance’s legal rights or interests or to defend any claims
  2. necessary to prevent or lessen a serious threat to a person’s health or safety or
  3. as required by law.

Where you apply for credit with Reliance, we need to decide whether or not you can repay that credit. Our decision will be based on your, or your business’ current financial position and on your credit history. We will consider the information you give us when you fill out your application and may check that information with a credit reporting agency.

In checking with a credit reporting agency, we are looking to confirm the completeness and accuracy of information you have provided on your application form. This helps you as well as us because we do not want to give you further credit if, given your current financial commitments, you may have difficulty in repaying us. Under the Privacy Act, we can only give information about you to a credit reporting agency if we first have told you that we will do so and we can only obtain information about you from a credit reporting agency if we have your consent. In the Terms and Conditions of Reliance’s Credit Application Agreement, we advise you that such information may be exchanged with a credit reporting agency or another credit provider.

You may obtain a copy of credit reports about you as detailed later in this Policy.

Under no circumstances will Reliance sell personal information without the consent of the person to whom it relates.

Disclosure Between Reliance Companies in Australia

Reliance and its subsidiary companies may disclose personal information between themselves or to a related company in Australia subject always to the companies complying with the provisions of the Privacy Act. Any related company will only use the personal information for the same purposes that the disclosing Reliance Company is authorised to use the personal information for and they will use it in accordance with the Privacy Act.

Disclosure Outside Australia

Reliance will not transfer personal information overseas to a third party unless:

  1. Reliance has the consent of the person to whom the information relates to do so
  2. the receiving party provides commitments to privacy and confidentiality which are at least equal to the National Privacy Principles or
  3. the receiving party is subject to privacy protection laws that offer at least the same level of protection as required under the Privacy Act in Australia.

Personal Information Quality

We aim to ensure that the personal information that we hold is accurate, complete and up to date. Reliance will take all reasonable steps to ensure this however, if any person believes that any personal information we hold is inaccurate or out of date then that person should contact Reliance in writing at the address below and inform us of the inaccuracy so that we may correct it.

Information Security

Reliance takes all reasonable steps to ensure all personal information held by Reliance is secured from unauthorised access or disclosure. However, Reliance does not guarantee that personal information cannot be accessed by unauthorised persons (e.g. a hacker) or that unauthorised disclosures will not occur.

Reliance will take steps to destroy or permanently de-identify personal information if it is no longer needed for the purposes for which Reliance is authorised to use it.

Accessing Personal Information

A person may request access to personal information about them held by Reliance. In order to do so, that request must be made in writing to the address below.

Reliance will grant a person access to their personal information as soon as possible subject to the circumstances of the request. Reliance may charge a fee for the reasonable costs incurred in responding to an access request. Upon receipt of a request, Reliance will give an estimate of the access charge and give you the opportunity to confirm that you wish to proceed. A request to access personal information will be rejected if:

  1. the request is frivolous or vexatious
  2. providing access would have an unreasonable impact on the privacy of another person
  3. providing access would pose a serious and imminent threat to the life or health of any person
  4. providing access would prejudice Reliance’s legal rights or
  5. there are any other legal grounds to deny the request.

You have the right to ask for a copy of any credit report we have obtained about you from a credit reporting agency. However, Reliance may not retain a copy of that report after we have used it and the best means of obtaining an up to date copy is to get in touch with the credit reporting agency direct.

If we decline your credit application wholly or partly because of adverse information on your credit report, the Privacy Act requires us to tell you of that fact and how you can go about getting a copy of your credit report.
